These Terms of Service (“Terms”) govern your use of shopkulta.com and any purchase from KULTA (the “Services”). By accessing the Services or placing an order, you agree to these Terms. If you do not agree, do not use the Services.
1. Online store terms
You must be at least the age of majority in your jurisdiction, or have permission from a parent or legal guardian, to use the Services. You may not use the Services for any unlawful or unauthorized purpose.
2. Products and availability
We make reasonable efforts to display product descriptions, materials, measurements, colors and images accurately. Screen settings and the handmade or natural character of some materials can cause minor variation. Products, prices and availability may change without notice. We may limit quantities or discontinue products.
3. Orders and payment
Submitting an order is an offer to purchase. We may accept, reject or cancel an order for legitimate reasons, including suspected fraud, payment failure, inventory error, pricing error, shipping restriction or unauthorized resale. If we cancel after payment, we will refund the amount charged. You agree to provide current, complete and accurate billing, shipping and contact information.
4. Prices, taxes and charges
Prices are shown in the currency displayed at checkout. Shipping, taxes and any other applicable charges are shown before you complete the order where Shopify and the applicable services can calculate them. International duties and import fees are governed by our Shipping policy.
5. Shipping and delivery
Shipping availability, rates, tracking and estimated delivery windows are described in our Shipping & delivery policy. Delivery estimates are not guarantees and may be affected by carriers, customs, weather, remote-area service and other events outside our reasonable control.
6. Returns, refunds and order issues
Returns, refunds, replacements and damaged, defective, missing or incorrect items are governed by our Returns policy and the refund policy displayed at checkout. Nothing in these Terms limits mandatory cancellation, withdrawal, conformity, warranty or other consumer rights that apply in your location.
7. Personal information
Your submission of personal information through the Services is governed by our Privacy policy.
8. Intellectual property
The KULTA name, branding, website design, text, graphics, photographs and other content are owned by or licensed to KULTA and are protected by applicable intellectual property laws. You may use the Services only for personal, non-commercial shopping. You may not copy, reproduce, distribute, modify or commercially exploit our content without written permission.
9. Prohibited uses
You may not misuse the Services, interfere with their security or operation, introduce malicious code, scrape or collect data without authorization, impersonate another person, violate another person’s rights, or use the Services for unlawful, fraudulent or abusive activity.
10. Third-party services and links
The Services may rely on Shopify and other third-party providers for hosting, payments, fulfillment, shipping, analytics and related functions. Third-party websites and services may have their own terms and policies. We are not responsible for third-party content or services except to the extent required by applicable law.
11. Errors and changes
We may correct typographical errors, inaccuracies or omissions and update information when needed. If a material error affects an order you placed, we will contact you or cancel and refund the affected order as appropriate.
12. Disclaimer and limitation of liability
To the fullest extent permitted by law, the Services are provided on an “as available” basis. KULTA is not liable for indirect, incidental, special or consequential losses arising from use of the Services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limits mandatory consumer rights.
13. Indemnification
To the extent permitted by law, you agree to indemnify KULTA against third-party claims resulting from your unlawful misuse of the Services or your violation of these Terms.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect, and the affected provision will be enforced to the maximum extent permitted by law.
15. Termination
We may suspend or terminate access to the Services for material violation of these Terms or unlawful or harmful conduct. Obligations that by their nature should survive termination remain in effect.
16. Governing terms
These Terms are governed by applicable law. Any mandatory protections or jurisdiction rights available to consumers in their country or region remain unaffected.
17. Changes to these Terms
We may update these Terms from time to time by posting the revised version on this page. Changes apply from the posted effective date and do not retroactively remove rights already acquired under an accepted order.
